The following "Terms & Conditions" are applicable to "Smiles"- the Loyalty Program of Sharjah Islamic Bank for the Master Card Covered Card. When you become an SIB Smiles Accountholder, you agree to follow the Terms & Conditions. It is important to know that the following Therms and Conditions may be changed by addition of new criteria, updated or replaced information or any other such actions at anytime otherwise wishedso by SIB.
1.1 "Smiles" means the rewards program established by SIB and subject to these Terms & Conditions. "Smiles" also refers to the reward points credited/debited to the Rewards Account as a result of using the SIB MasterCard Covered Card
1.2 "Smiles Account" means the account reflecting all transactions relating to Smiles for a particular Smiles Accountholder i SIB's records.
1.3 "Smiles Accountholder" means the in relation to each Smiles Relationship, the customer or, where there is more than one person comprising the customer, the first named signatory holding such relationship.
1.4 "Smiles Booking Policy" means the booking policy to redeem Smiles as published from time to time on the Smiles Website.
1.5 "Smiles Statement" means a record all the transactions done on the Covered Card accumulated points.

2.1 All customers who have received an SIB Covered Card will immediately be enrolled in the Smiles Loyalty Program and thus be eligible to earn Smiles on retail transactions
2.2 The Smiles membership is limited to the primary (i.e first named) customer accountholder. The membership allows the Smiles Accountholder to take advantage of special offers and promotions available to the Covered Card Customer, as well as accumulating points to redeem on gifts.
2.3 In the case of joint or supplementary SIB Covered Card Holders, all authorized signatories will be automatically enrolled in the Smiles program and accrue Smiles, but only the primary account older (i.e first named) can be qualified for redemption.
2.4 In the event of a change to the status of a SIB Covered Card (i.e from card to card or transfer of name), the future calculation of Smiles Points shall be adjusted by SIB accordingly.
2.5 If a customer account signatory (ies) or a supplementary cardholder(s) is/are removed from the Covered Card Account, then they shall no longer participate in the Smiles Reward Program.
2.6 Membership with "Smiles" is automatically terminated upon the death, bankruptcy, or unsatisfactory conduct of the account or relationship of the primary (i.e first named)
2.7 Sharjah Islamic Bank reserves the right, at any time and without notice and liability, to impose a validity period on membership, as well as to extend or reduce the same.
2.8 Membership in the Smiles Reward Program is automatic for every SIB Customer holding the Covered Card and who is in good terms i.e no breach of any Terms & conditions.
2.9 11.3 You must promptly notify us in writing of any changes in your name, employment or business and address including phone number, email, etc.
2.10 Should you be away from the UAE for more than 6-month, you must settle the Card Account in full seven (7) days prior to your departure.
2.11 If you leave the UAE to take up residence elsewhere, the Card (including any Supplementary Card) must be returned to us cut in half fourteen (14) days prior to your departure and its/their use shall be deemed to be terminated.
3.1 The Smiles Reward Program allows eligible Sharjah Islamic Bank Covered Cardholders to accumulate points when they spend on their MasterCard Covered Card.
3.2 As of now, Smiles can only be accrued on the Covered Card. Sharjah Islamic Bank may add other card to the Rewards system in the future.
3.3 The Bank reserves the right to withdraw/discontinue the Smiles Reward Program, terminate your participation in the same and/or revoke any accrued points, at its sole discretion and without any prior notice to the Customer.
3.4 If the cardholder chooses to terminate his own Covered card, the customer stands to forfeit all Smiles accrued so far.
3.5 If the Bank decides to terminate the relationship with the Cardholder for any reason, then all smiles accumulates thus far shall be forfeited.
3.6 Participation the Smiles Reward Program is free to all customers having the SIB Covered Card.
3.7 "Smiles" will only be rewarded on POS retail transactions (domestic/international) only.
3.8 The rate of earning Smiles Reward Points is available in the Rewards & Benefits booklet and can also be viewed online. SIB reserves the right to change the ratio of Smiles earned- amount spent, at any time and without prior notice to the Cardholder.
3.9 In the case of joint or multiple holders of the Covered Card, all authorized signatories shall be enrolled in the Smiles Reward Program; however, the use and redemption of points shall only be available to the primary Cardholder.
3.10 Smiles Reward Points will stop accruing if the Cardholder fails to pay the Minimum Amount Due on the Card Account on 2 consecutive Payment Due Dates.
3.11 The Bank's decision on calculation of Smiles shall be final, conclusive and binding on the Cardholder.
3.12 The Bank reserves the right to alter the computation of Smiles earning at any point in time with or without prior intimation to the customer.
3.13 Sharjah Islamic Bank reserves the right to amend, change, terminate any eligible product and service categories at any time, amend eligibility and participation criteria, limit or change the value of points, at its sole and absolute discretion, without notice to the Customer and without liability whatsoever on the part of the Bank.
3.14 Smiles will have an expiry date of 3 years.
3.15 Smiles are not assignable or otherwise transferable, and are not capable of being mortgaged, charged or pledged, nor can Smiles Reward Points of different accounts be combined for redemption.
4.1 Redemption may only be placed from the dedicated Rewards platform on www.smiles.com
4.2 The Cardholder may only redeem the Smiles registered and credited to the SIB Covered Card up until the time of redemption.
4.3 Once redeemed, points are not exchangeable, returnable, refundable, or redeemable for cash or credit and cannot be cancelled.
4.4 Redemption of Smiles will not be allowed if monthly minimum payment due has not been cleared on the card for one statement cycle.
4.5 "Smiles" may be cancelled if the cardholder has violated the Banks/ MasterCard's Agreement
4.6 Once a purchase order is submitted for redemption, it cannot be canceled, revoked, transferred or changed in any manner.
4.7 Sharjah Islamic Bank may share non-financial and non-personal Customer information with third-party merchants required to effectively transition duties from redemption until delivery.
4.8 Redemption is only available on the products shown on the Smiles Redemption website; in no additions at all requested by the customer.
4.9 Any order placed for the redemption of Smiles is subject to the Bank's approval, the availability of the Reward at the time of placing the redemption order by the Cardholder, as well as any restrictions applied by the suppliers of the Reward. The Bank may, without prior notice to the Cardholder withdraw or substitute any of the Rewards for another Reward of comparable value or nature.
4.10 Any unprocessed redemption order for Reward Points that have been cancelled, shall not be processed by the Bank despite the fact that such redemption order was received before the Cardholder's relevant Reward Points cancellation.
4.11 A Call Centre agent may call the Customers upon redemption to ask for delivery instructions.
4.12 Sharjah Islamic Bank is not liable for the availability, pricing, qualityand such for the third party merchants.
5.1 Sharjah Islamic Bank, its employees, personnel, directors or owners shall not be liable for any loss of profit, savings, revenue or damage or liability of any nature, including any direct or indirect loss arising from the use of the Smiles Reward Program or from accessing any information that may be displayed therein.
5.2 Sharjah Islamic Bank will not be responsible or held liable for any amount payable by the Cardholder to any third party arising out of the purchase, supply, quality, installation, use or other wise of Rewards, or of any negligence, breach of statutory or other duty on the part of the Bank and/or the supplier.
5.3 Sharjah Islamic Bank will not be responsible for any extra payments to be paid for gifts/vouchers between the customer and the merchant, should the Smiles points not be sufficient for the required redemption.
5.4 n case any merchant refuses the acceptance of the MasterCard due to any other reason, Sharjah Islamic Bank shall not be liable
5.5 Sharjah Islamic bank shall not be liable for defect or deficiency in the goods or services supplied to you by any Merchant or non performance.
5.6 We shall not be liable for any loss or damage howsoever incurred or suffered by you by reason of us or a Merchant or any bank or financial institution or any ATM or other party refusing to allow a Card Transaction, or accept the Card or the Card number or the PIN or to extend or provide a cash withdrawal up to the Limit or at all.
5.7 We shall not be liable for any disputes brought to our notice by you after 30 days from the date of the relevant statement of account.
5.8 We shall not be liable for any refusal of any merchant to extend or confer any privilege or benefit under any Programme for any reason whatsoever.
5.9 We shall not be liable to you in the following circumstances:
6.1 Sharjah Islamic Bank reserves the right to disqualify any customer at any time from participating in the Smiles Reward Program and terminate the relationship if, in its sole and absolute judgment, the Customer violated any of the terms & conditions applicable to the Mashreq Salaam Carats Reward Program, including but not limited to default of payment or fraud.
6.2 The Bank reserves the right, at its discretion to:
6.3 Sharjah Islamic Bank should not be liable in any personal cases pertaining of the redemption of Smiles.
6.4 These Terms & Conditions shall be governed by the Federal laws of the United Arab Emirates and the Emirate of Sharjah providing these laws do not contradict the principles of Sharia in which case the principles of Sharia shall prevail.
7.1 The customer authorizes Sharjah Islamic Bank to disclose and record any phone calls for reference and to use such records as evidence in legal proceedings.
7.2 This Agreement shall be available in Arabic and English versions and in case of any difference between such Arabic and English versions, the Arabic version will prevail
7.3 It is in the free interest of Sharjah Islamic Bank to check or authorize through any means or delegations, a customer's credit score at any time and without consulting with you.
7.4 Our authority to disclose information obtained by us shall survive the termination of this Agreement.
7.5 You agree to sign and deliver to us such further documents as we may request from time to time.
7.6 All demands, notices and other communications sent under this Agreement to you and to any Supplementary Cardholder(s) shall be deemed to have been sent to both.
7.7 For the purpose of assessing your creditworthiness, you authorise:
7.8 Our rights under this Clause shall be in addition and without prejudice to other rights of disclosures available pursuant to the relevant governing laws or any other statutory provision and nothing herein is to be construed as limiting any of these other rights.
8.1 We shall not be liable for acting in good faith upon your instructions.
8.2 No forbearance or failure or delay by us in exercising any right, power or remedy is to be deemed a waiver or partial waiver thereof on our part; and no waiver by us of any breach of this Agreement on your part is to be considered a waiver of any subsequent breach of the same or any provision of this Agreement. We shall be considered to have waived our rights only if we specifically notify you of such a waiver in writing.
8.3 In addition to any other right we may have either under this Agreement or under law, We may at any time and without prior notice or demand combine or consolidate any and all accounts maintained by you with us (whether matured or not) and regardless of where your accounts are located or whether your accounts are held in your sole name or jointly with others (including with one or more of the Supplementary Cardholder(s)) and set off or transfer any sum standing to the credit in any or all such accounts in or towards the discharge or payment of any and all sums due to us from you on any Card Account or under this Agreement notwithstanding that
8.4 We may at any time at its absolute discretion and upon written notice to you or by written intimation, change any one or more of the terms & conditions in this Agreement (the "Amendments"). Such change shall take effect from the date stated in the notice. If you do not accept such change, you shall forthwith discontinue use of the Card and instruct us to terminate the Card. Where you continue to use the Card after such notification, you shall be deemed to have agreed with and accepted such change.
8.5 All communications, cards, notices, statements of account, demands or other documents under this Agreement may be delivered personally to you or sent by post or email to the last known address at your sole risk. Each such communication or other material shall be deemed to have been received and served on you on the day of delivery if delivered personally or via email and two business days after posting, if sent by post.
8.6 Instructions provided for above shall be considered valid and binding on you and we may act upon the instructions received by us through the means stated hereabove.
8.7 In addition to these Terms & Conditions, each Smiles Accountholder continues to be subject to the General Terms & Conditions of Account Opening and the terms & conditions applicable to the relevant SIB Covered Card.
